  2.                Binary Code License Agreement
  3.  
  4. READ THE TERMS OF THIS AGREEMENT AND ANY PROVIDED
  5. SUPPLEMENTAL LICENSE TERMS (COLLECTIVELY "AGREEMENT")
  6. CAREFULLY BEFORE OPENING THE SOFTWARE MEDIA PACKAGE.
  7. BY OPENING THE SOFTWARE MEDIA PACKAGE, YOU AGREE TO
  8. THE TERMS OF THIS AGREEMENT.  IF YOU ARE ACCESSING THE
  9. SOFTWARE ELECTRONICALLY, INDICATE YOUR ACCEPTANCE OF
  10. THESE TERMS BY SELECTING THE "ACCEPT" BUTTON AT THE
  11. END OF THIS AGREEMENT.  IF YOU DO NOT AGREE TO ALL
  12. THESE TERMS, PROMPTLY RETURN THE UNUSED SOFTWARE TO
  13. YOUR PLACE OF PURCHASE FOR A REFUND OR, IF THE
  14. SOFTWARE IS ACCESSED ELECTRONICALLY, SELECT THE
  15. "DECLINE" BUTTON AT THE END OF THIS AGREEMENT.
  16.  
  17. 1.  LICENSE TO USE.  Sun grants you a non-exclusive
  18. and non-transferable license for the internal use only
  19. of the accompanying software and documentation and any
  20. error corrections provided by Sun (collectively
  21. "Software"), by the number of users and the class of
  22. computer hardware for which the corresponding fee has
  23. been paid.
  24.  
  25. 2.  RESTRICTIONS Software is confidential and
  26. copyrighted.  Title to Software and all associated
  27. intellectual property rights is retained by Sun and/or
  28. its licensors.  Except as specifically authorized in
  29. any Supplemental License Terms, you may not make
  30. copies of Software, other than a single copy of
  31. Software for archival purposes.  Unless enforcement is
  32. prohibited by applicable law, you may not modify,
  33. decompile, reverse engineer Software.  Software is not
  34. designed or licensed for use in on-line control of
  35. aircraft, air traffic, aircraft navigation or aircraft
  36. communications; or in the design, construction,
  37. operation or maintenance of any nuclear facility.  You
  38. warrant that you will not use Software for these
  39. purposes.  You may not publish or provide the results
  40. of any benchmark or comparison tests run on Software
  41. to any third party without the prior written consent
  42. of Sun.  No right, title or interest in or to any
  43. trademark, service mark, logo or trade name of Sun or
  44. its licensors is granted under this Agreement.

  46. 3. LIMITED WARRANTY.  Sun warrants to you that for a
  47. period of ninety (90) days from the date of purchase,
  48. as evidenced by a copy of the receipt, the media on
  49. which Software is furnished (if any) will be free of
  50. defects in materials and workmanship under normal
  51. use.  Except for the foregoing, Software is provided
  52. "AS IS".  Your exclusive remedy and Sun's entire
  53. liability under this limited warranty will be at Sun's
  54. option to replace Software media or refund the fee
  55. paid for Software.

  57. 4.  DISCLAIMER OF WARRANTY.  UNLESS SPECIFIED IN THIS
  58. AGREEMENT, ALL EXPRESS OR IMPLIED CONDITIONS,
  59. REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED
  60. WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
  61. PURPOSE, OR NON-INFRINGEMENT, ARE DISCLAIMED, EXCEPT
  62. TO THE EXTENT THAT THESE DISCLAIMERS ARE HELD TO BE
  63. LEGALLY INVALID.
  64.  
  65. 5.  LIMITATION OF LIABILITY.  TO THE EXTENT NOT
  66. PROHIBITED BY LAW, IN NO EVENT WILL SUN OR ITS
  67. LICENSORS BE LIABLE FOR ANY LOST REVENUE, PROFIT OR
  68. DATA, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL,
  69. INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER CAUSED
  70. REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF
  71. OR RELATED TO THE USE OF OR INABILITY TO USE SOFTWARE,
  72. EVEN IF SUN HAS BEEN ADVISED OF THE POSSIBILITY OF
  73. SUCH DAMAGES.  In no event will Sun's liability to
  74. you, whether in contract, tort (including negligence),
  75. or otherwise, exceed the amount paid by you for
  76. Software under this Agreement.  The foregoing
  77. limitations will apply even if the above stated
  78. warranty fails of its essential purpose.
  79.  
  80. 6.  Termination.  This Agreement is effective until
  81. terminated.  You may terminate this Agreement at any
  82. time by destroying all copies of Software.  This
  83. Agreement will terminate immediately without notice
  84. from Sun if you fail to comply with any provision of
  85. this Agreement.  Upon Termination, you must destroy
  86. all copies of Software.

  88. 7.  Export Regulations.  All Software and technical
  89. data delivered under this Agreement are subject to US
  90. export control laws and may be subject to export or
  91. import regulations in other countries.  You agree to
  92. comply strictly with all such laws and regulations and
  93. acknowledge that you have the responsibility to obtain
  94. such licenses to export, re-export, or import as may
  95. be required after delivery to you.

  97. 8.  U.S. Government Restricted Rights.  Use,
  98. duplication, or disclosure by the U.S. Government is
  99. subject to restrictions set forth in this Agreement
  100. and as provided in DFARS 227.7202-1 (a) and
  101. 227.7202-3(a) (1995), DFARS 252.227-7013
  102. (c)(1)(ii)(Oct 1988), FAR 12.212 (a) (1995), FAR
  103. 52.227-19 (June 1987), or FAR 52.227-14(ALT III) (June
  104. 1987), as applicable.

  106. 9.  Governing Law.  Any action related to this
  107. Agreement will be governed by California law and
  108. controlling U.S.  federal law.  No choice of law rules
  109. of any jurisdiction will apply.
  110.  
  111. 10.  Severability. If any provision of this Agreement
  112. is held to be unenforceable, This Agreement will
  113. remain in effect with the provision omitted, unless
  114. omission would frustrate the intent of the parties, in
  115. which case this Agreement will immediately terminate.

  117. 11.  Integration.  This Agreement is the entire
  118. agreement between you and Sun relating to its subject
  119. matter.  It supersedes all prior or contemporaneous
  120. oral or written communications, proposals,
  121. representations and warranties and prevails over any
  122. conflicting or additional terms of any quote, order,
  123. acknowledgment, or other communication between the
  124. parties relating to its subject matter during the term
  125. of this Agreement.  No modification of this Agreement
  126. will be binding, unless in writing and signed by an
  127. authorized representative of each party.

  133.     VERSION 1.2.1 SUPPLEMENTAL LICENSE TERMS

  135. These supplemental terms ("Supplement") add to the
  136. terms of the Binary Code License Agreement
  137. ("Agreement").  Capitalized terms not defined herein
  138. shall have the same meanings ascribed to them in the
  139. Agreement.  The Supplement terms shall supersede any
  140. inconsistent or conflicting terms in the Agreement.
  141.  
  142. 1. Limited License Grant. Sun grants to you a
  143. non-exclusive, non-transferable limited license to use
  144. the Software without fee for evaluation of the
  145. Software and for development of Java(TM)  applets and
  146. applications provided that you: (i) may not
  147. re-distribute the Software in whole or in part, either
  148. separately or included with a product.  (ii) may not
  149. create, or authorize your licensees to create
  150. additional classes, interfaces, or subpackages that
  151. are contained in the "java" or "sun" packages or
  152. similar as specified by Sun in any class file naming
  153. convention; and (iii) agree to the extent Programs are
  154. developed which utilize the Windows 95/98 style
  155. graphical user interface or components contained
  156. therein, such applets or applications may only be
  157. developed to run on a Windows 95/98 or Windows NT
  158. platform.  Refer to the Java Runtime Environment
  159. Version 1.2.1 binary code license
  160. (http://java.sun.com/products/JDK/1.2/index.html) for
  161. the availability of runtime code which may be
  162. distributed with Java applets and applications.  2.
  163. Java Platform Interface. In the event that Licensee
  164. creates an additional API(s) which: (i) extends the
  165. functionality of a Java Environment; and, (ii) is
  166. exposed to third party software developers for the
  167. purpose of developing additional software which
  168. invokes such additional API, Licensee must promptly
  169. publish broadly an accurate specification for such API
  170. for free use by all developers.

  172. 3. Trademarks and Logos. This Agreement does not
  173. authorize Licensee to use any Sun name, trademark or
  174. logo. Licensee acknowledges as between it and Sun that
  175. Sun owns the Java trademark and all Java-related
  176. trademarks, logos and icons including the Coffee Cup
  177. and Duke ("Java Marks") and agrees to comply with the
  178. Java Trademark Guidelines at
  179. http://java.sun.com/trademarks.html.
  180.  
  181. 4.  High Risk Activities.  Notwithstanding Section 2,
  182. with respect to high risk activities, the following
  183. language shall apply: the Software is not designed or
  184. intended for use in on-line control of aircraft, air
  185. traffic, aircraft navigation or aircraft
  186. communications; or in the design, construction,
  187. operation or maintenance of any nuclear facility. Sun
  188. disclaims any express or implied warranty of fitness
  189. for such uses.

  191. 5.  Source Code.  Software may contain source code
  192. that is provided solely for reference purposes
  193. pursuant to the terms of this Agreement.
